Terms of Use

These Terms of Use ("Terms") are an agreement between you and DhuRee Labs Inc. ("we", "us", "our"), a company based in Ontario, Canada. They govern your use of the Diagramium web application, website, templates, narrated tours, exports and related features (together, the "Service"), available on this website.

Scope. These Terms cover the Diagramium service available on this website only.

1. Acceptance of these Terms

By using the Service, you agree to these Terms and acknowledge the Privacy Policy (which also covers browser storage and our service providers) and the Content Disclaimer. The Accessibility Statement and the Open-Source and Third-Party Notices, each available on this website, provide additional information but do not create separate contractual warranties or obligations. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization (for example, an employer or an educational institution), you confirm that you are an adult representative authorized to bind that organization, and "you" includes it.

2. Who may use Diagramium — 18 or older only

You must be at least 18 years old to access or use Diagramium, including its accountless editor, ready-made diagrams, presentation features and optional account features. By accessing or using Diagramium, you confirm that you are at least 18 years old. Users under 18 are not permitted to access or use the Service, even with the permission or supervision of a parent, guardian, teacher or school.

• The minimum age is the same for every part of the Service: accountless use and signed-in use are both restricted to people aged 18 or older, and signing out does not change that.
• Before signing in you must confirm, by ticking an unchecked confirmation box, that you are at least 18 years old and accept these Terms and the Privacy Policy; accountless use shows a one-time acknowledgement of the same rule. Each is a declaration you make; Diagramium does not verify your age, and Google sign-in is an identity and sign-in method only.
• If we reasonably believe that an account belongs to a person under 18, we may suspend or delete it (see Section 16). Suspected underage accounts can be reported to admin@dhureelabs.com.
• You may not use the Service if the laws that apply to you prohibit it.

Creating an account is optional and is the only part of the Service that stores personal information that identifies you with us; the engagement events we record about ready-made diagrams — opened, presented, liked, shared or watched, with no account or session identifier attached — are described in the Privacy Policy.

3. What the Service is

Diagramium is a local-first diagram editor that runs entirely in your browser:

• Free accountless use. You can browse ready-made diagram templates, create, edit, present and export diagrams without registering. No account is needed to draw.
• Local-first storage. Your diagrams are saved automatically to your browser's local storage on your own device, and to files you choose to save or export. No feature uploads your diagrams to us.
• Two kinds of catalogue diagram. Most ready-made diagrams are starting points: open one and it becomes an ordinary diagram of yours to edit, save and export. A smaller set are watch-only presentations — the ones built around pre-produced studio narration (synthesized speech, not a human recording) and step illustrations we produced. Those play in Present mode on any device and can be shared as a watch link, but they do not open in the editor and cannot be copied into your own work, because that pre-produced narration and artwork are not yours to take (see Section 7). The gallery marks which is which before you open anything.
• Optional free account. You may sign in to sync a small amount of account data (your favorites and likes) across devices; a free account also unlocks the animated exports (GIF, video, animated SVG) and the unbranded export. There are no paid plans — every account is the same free account. Section 4 describes accounts.
• Engagement counters. Each catalogue diagram shows public aggregate totals — opens, plays, likes, shares, watch time — moved by the non-account-linked engagement events described in the Privacy Policy.
• Delivery. The site, its code, templates, narration audio and other assets are served by our web host and database provider, named in the Privacy Policy.

4. Accounts and sign-in

• Sign-in is through a third-party provider only. You sign in with an existing Google account. Diagramium has no password of its own: we never see, set or store a Diagramium password, and there is no email/password sign-up. Google sign-in identifies you; it does not verify your age or enforce the age requirement in Section 2 — the confirmation you tick before signing in does not either; it records your own declaration.
• Age confirmation and acceptance record. Before your first sign-in you must tick an unchecked box confirming that you are at least 18 years old and that you accept these Terms and the Privacy Policy. When your account is created — and again if you accept updated versions after a material change to these documents — we store a record of that acceptance: your account identifier, the document versions accepted and the time. It is a record of your declaration, not proof or verification of age. The Privacy Policy describes this record.
• What we receive. When you sign in, we store the name, email address and avatar image your provider shares, your account type (every account is the same free account), and the acceptance record described above. The Privacy Policy has the details.
• Your provider account is your responsibility. You are responsible for the security of the Google account you sign in with, including its password, recovery settings and any activity through it. If you lose control of that provider account, someone else may be able to access your Diagramium account; tell us at admin@dhureelabs.com if you believe that has happened.
• Accurate information. Keep your account information accurate. Do not impersonate anyone or sign in with a provider account you are not authorized to use.
• One person per account. Your account is personal to you. Do not sell, transfer or share it.

5. Your content

• You own your diagrams. You retain all rights in the original diagrams, text and other content you create with Diagramium. We claim no ownership of your content, and we receive no licence to diagrams stored on your device — they never reach us.
• We mostly never receive it. Because the Service is local-first, your diagrams stay on your device. Today, the only content-related data you can send us from within the app is account data such as your favorite and liked template selections, which sync when you are signed in, plus the non-account-linked engagement events described in the Privacy Policy. No save or export path transmits your diagram documents to us.
• Limited license, only when you invoke a feature. If you use a feature that necessarily sends content to us or our service providers (today, that is syncing your favorites and likes), you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display and process that content solely to the extent needed to operate the feature you invoked. This license is not for advertising, training, resale or any other purpose. It ends when you delete the content from the feature or close your account, except for short-lived routine backups made by our service providers and anything we must keep to comply with law.
• Signals you contribute. Pressing like or share on a catalogue diagram, and playing one in Present mode, adds to that diagram's public totals — view counts, like counts and total watch time, shown on its tile and on its presentation's title slide. Those totals describe the diagram, never you: a like placed while signed out carries no identifier, and a like placed while signed in is stored against your account so you can remove it (deleting your account removes it too). The Privacy Policy describes exactly what is recorded and how to switch the measurement off.
• Your responsibility for your content. You are responsible for what you create, import, include or share, and you confirm you have the rights needed for any third-party material you bring in — images and logos you upload, text you paste, content you import. Material inserted from the app's own libraries (for example, icons) carries the third-party terms in the Open-Source and Third-Party Notices.

6. Local storage, backups and losing work

This section matters more than it looks:

• Your diagrams are stored in your browser's local storage on your device. Browser storage can be deleted, evicted or corrupted: if you clear your browser's site data, use private/incognito mode (which discards everything when the window closes), or your browser evicts stored data, locally stored diagrams are permanently deleted. We cannot recover them, because we never had them.
• You are responsible for backing up work you care about. Use File → Save to keep diagrams as files on your device, and export copies (for example the project file format) of anything important.
• Work saved to files on your device is likewise outside our control and is your responsibility to keep safe.

7. Our intellectual property

The Service — including the application code, the Diagramium name and brand, the visual design, the template library (structure, labels, step notes and descriptions), narrated tours and their narration scripts and audio, step illustrations and cover art, presenter artwork, music and sounds (generated by our own software), the first-party icon set, documentation and the site's written content — is owned by DhuRee Labs Inc. or licensed to us, to the extent applicable rights exist, and is protected by copyright, trademark and other laws. Except for the licenses these Terms expressly grant, we reserve all rights.

Three honest notes on the edges of that claim:

• Facts, ideas, methods and standard processes are not ours. A diagram's depiction of a well-known process or standard is our expression; the underlying facts and methods belong to no one.
• Some materials are made with AI assistance — some template text, the step illustrations and the synthesized narration audio. The copyright treatment of AI-assisted and AI-generated material varies by jurisdiction and by the degree of human authorship; we claim rights in these materials to the extent the applicable law recognizes them.
• Third-party materials stay third-party. Bundled open-source software and icon sets remain under their own licences, listed in the Open-Source and Third-Party Notices.

8. Your license to use the Service, templates and exports

Subject to these Terms, we grant you a free, worldwide, non-exclusive, non-transferable license to:

• use the Service for any lawful purpose, personal or commercial;
• use the built-in templates, icons, narration and other assets within the Service to create your diagrams. This applies to the ready-made diagrams the gallery offers as starting points; the watch-only presentations described in Section 3 are licensed to play and share as presentations, not to open, edit, copy or extract — their pre-produced narration and step illustrations stay ours; and
• use, publish and commercially exploit the diagrams you export, including diagrams built from our templates, with no fee and no attribution required. Starting from a template does not make the template yours — what you own is your arrangement, your text, your changes and your original additions.

Two clarifications about what an export contains:

• Third-party pieces keep their own terms. An exported diagram that includes bundled third-party icons, or images and logos you added yourself, is yours to use — but those pieces remain subject to their own licences, trademark rights and any attribution requirements (see the Open-Source and Third-Party Notices), so we cannot promise that every element of every export is exclusively yours.
• A logo is not a licence. Naming a company or placing its logo in a diagram identifies it; it grants you no trademark rights and implies no affiliation, sponsorship or endorsement — in either direction.

What this license does not allow:

• extracting, scraping, copying or redistributing the template library, narration audio files, presenter artwork, icon compilation or other app assets as such — that is, as assets or collections separate from a diagram you made;
• offering the templates, narration or the app itself (or a substantial copy of any of them) as your own product or a competing library or service, or white-labelling or embedding the app in your own product without a written license from us;
• removing or falsifying notices of ownership, or presenting exported diagrams as certified, endorsed or produced by us;
• reverse engineering or copying the Service's code except where the law gives you a right we cannot exclude.

9. Acceptable use

Diagrams that stay on your device are yours and are invisible to us: we cannot see them, we do not scan them, and we cannot moderate them. The rules below therefore govern the hosted parts of the Service — the website, the catalogue, accounts, sync, the engagement counters — and your use of the app and its assets. Using the hosted parts, do not:

• break the law, or help anyone else break it;
• infringe others' rights — copyright, trademark, confidentiality, privacy;
• distribute malware or phishing content, run scams, or present deliberately false content as genuine;
• attack or misuse the Service or its infrastructure: probing or testing its security without written permission, denial-of-service, bypassing access controls (including database row-level security), or using our publishable API key outside the app to read or write data you are not authorized to access;
• scrape, bulk-download or systematically extract the catalogue or other hosted data, evade rate limits or blocks, or use bots or automated access in ways a normal user could not;
• impersonate any person, or impersonate Diagramium or DhuRee Labs Inc. — including copycat sites and unauthorized use of our name or branding;
• misuse accounts (bulk or automated account creation, using another person's account or credentials, sharing yours) or artificially inflate or deflate the public engagement figures — views, likes, shares, watch time;
• resell, rent or sublicense access to the Service, or redistribute our application or asset library as a competing product (Section 8).

You are responsible for what you create and how you use it once you export or share it yourself, outside our hosted services. To report abuse on a hosted surface, email admin@dhureelabs.com with where you saw it and what the problem is; security vulnerabilities should be reported to the same address rather than exploited. We review reports but cannot promise a specific outcome or response time, and we have no obligation to monitor hosted content.

10. Reporting copyright or trademark infringement

We can act only on content hosted on our services — the ready-made catalogue and our own site pages. Because Diagramium is local-first, we hold no copy of users' private diagrams and cannot see or remove them.

To send a complaint, email admin@dhureelabs.com with the subject "Copyright complaint" or "Trademark complaint" and include: the work or mark concerned (with registration details for a registered mark); the exact URL or location of the content on our services; why the use is infringing or confusing; your name, mailing address and email address, and your right or interest in the work or mark; and a good-faith statement that your complaint is accurate. We acknowledge, review, remove or disable well-founded matter from hosted surfaces, keep a record, and where feasible notify the affected user, who may send a reasoned counter-statement to the same address; we may restore content where restoration appears justified, and we may share a counter-statement with the complainant. We are a Canadian service: this is our voluntary complaints procedure under the Copyright Act (Canada), we handle "notice and notice" forwarding where the Act requires it, and we treat notices prepared under other regimes (for example a US DMCA notice) as complaints under this section when they contain the information above. Knowingly false complaints may expose you to liability, and repeat infringers' accounts may be suspended or terminated. Simply naming a product or company in a diagram is generally a descriptive reference we will not remove unless it is likely to confuse people about source, sponsorship or endorsement.

11. Feedback

If you send us ideas or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation to you. Please do not send ideas you consider confidential.

12. The Service is free

• The editor is free, and you can use it without an account. There is nothing to buy in the Service today; if that ever changes, these terms and the relevant policies will be updated before anything is offered for sale.

13. Availability and changes to the Service

• We work to keep the Service available but do not promise uninterrupted, error-free operation. Features may change, be added or be removed.
• We do not promise that any particular feature or template will remain available forever. However, content stored on your device remains yours and on your device regardless of what happens to the Service.
• If Diagramium introduces a feature that materially changes how information or user content is handled, we will update the applicable terms and privacy disclosures before that feature becomes available.
• If we discontinue the Service, we will give reasonable advance notice where practicable so you can export your work — noting that, because your diagrams are already on your device, discontinuation does not by itself delete anything of yours.

14. No warranties

The Service is free and provided "as is" and "as available". To the maximum extent permitted by applicable law, we make no warranties or conditions of any kind — express, implied or statutory — and we do not promise the Service will be error-free, secure, uninterrupted, accurate or fit for any particular purpose. Nothing in these Terms removes rights that applicable law (including applicable Ontario consumer-protection legislation) does not allow to be removed.

15. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any loss or damage arising out of the Service or these Terms — including indirect or consequential loss, loss of data, and loss of diagrams stored only on your own device — and our total liability for everything combined is limited to CAD $50 (the Service is free; there are no payments). Nothing in this section limits liability that applicable law does not allow to be limited, or any non-waivable consumer or privacy right, including under applicable Ontario consumer-protection legislation and PIPEDA.

16. Enforcement and termination

• By you: stop using the Service at any time; sign out whenever you like; delete your account yourself from the account panel — deletion is immediate and permanent (the Privacy Policy says exactly what it removes and what may briefly remain in provider backups). For help, contact admin@dhureelabs.com.
• By us, proportionately: for a minor problem we will normally warn first and ask you to fix it; we may remove or refuse content on hosted surfaces, apply technical restrictions, or suspend or delete an account that breaks these Terms (including Section 9), or that we reasonably believe belongs to a person under 18 (Section 2). For serious, unlawful or harmful conduct — malware, phishing, attacks on the Service, content involving minors — we may act immediately and without notice, and we may notify authorities where legally required or where there is a credible risk of serious harm. Because Diagramium can be used without an account, enforcement against misuse by visitors who have no account may be limited to technical measures.
• Challenging a decision: if you believe we suspended or deleted your account in error, email admin@dhureelabs.com and we will review it.
• Your local diagrams are unaffected either way — they stay on your device, because we do not possess or control them.

17. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes belong to the courts of Ontario. These Terms do not require arbitration, do not waive your right to go to court (including Small Claims Court) or to join a class proceeding, and do not take away mandatory consumer protections of the place you live.

18. Changes to these Terms

We may update these Terms. The current version, with its effective date, is always published on this website; we give reasonable advance notice of material changes where practicable; and changes apply from their effective date — keep using the Service and they apply to you, or stop using it (your local diagrams remain yours, on your device). After a material change, signed-in users may be asked to confirm acceptance again, recorded as in Section 4.

19. General

• Severability. If part of these Terms is unenforceable, the rest stands.
• Entire agreement. These Terms, with the policies in Section 1, are the whole agreement about the Service. They do not limit statutory rights consumer law gives you.
• No waiver. If we do not enforce a provision in one case, we may still enforce it in another.
• Assignment. You may not transfer these Terms. We may transfer them in a corporate sale or reorganization, with your rights preserved.
• Language. These Terms are drafted in English.
