Terms of Use

In short: Diagramium is a free, browser-based diagram editor. It is for adults: you must be at least 18 years old to use it, with or without an account. You can use it without an account. Your diagrams are yours and, by default, stay on your own device — we never receive them unless you use a feature that expressly sends something to us (today, that is account details such as synced favorites and likes, plus per-diagram engagement events that carry no account or session identifier — never your diagrams, and never what you search for). Use the hosted parts honestly and lawfully, keep your own backups (clearing your browser data deletes local work), and understand that we provide the app "as is" within the limits the law allows. Nothing in these terms takes away consumer rights that Ontario or Canadian law says you cannot give up.

These Terms of Use ("Terms") are an agreement between you and DhuRee Labs Inc. ("we", "us", "our"), a company based in Ontario, Canada. They govern your use of the Diagramium web application, website, templates, narrated tours, exports and related features (together, the "Service"), available on this website.

Scope. These Terms cover the Diagramium service available on this website only.

1. Acceptance of these Terms

By using the Service, you agree to these Terms and acknowledge the Privacy Policy (which also covers browser storage and our service providers) and the Content Disclaimer. The Accessibility Statement and the Open-Source and Third-Party Notices, each available on this website, provide additional information but do not create separate contractual warranties or obligations. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization (for example, an employer or an educational institution), you confirm that you are an adult representative authorized to bind that organization, and "you" includes it.

2. Who may use Diagramium — 18 or older only

You must be at least 18 years old to access or use Diagramium, including its accountless editor, ready-made diagrams, presentation features and optional account features. By accessing or using Diagramium, you confirm that you are at least 18 years old. Users under 18 are not permitted to access or use the Service, even with the permission or supervision of a parent, guardian, teacher or school.

Creating an account is optional and is the only part of the Service that stores personal information that identifies you with us; the engagement events we record about ready-made diagrams — opened, presented, liked, shared or watched, with no account or session identifier attached — are described in the Privacy Policy.

The Service — including the application code, the Diagramium name and brand, the visual design, the template library (structure, labels, step notes and descriptions), narrated tours and their narration scripts and audio, step illustrations and cover art, presenter artwork, music and sounds (generated by our own software), the first-party icon set, documentation and the site's written content — is owned by DhuRee Labs Inc. or licensed to us, to the extent applicable rights exist, and is protected by copyright, trademark and other laws. Except for the licenses these Terms expressly grant, we reserve all rights.

9. Acceptable use

Diagrams that stay on your device are yours and are invisible to us: we cannot see them, we do not scan them, and we cannot moderate them. The rules below therefore govern the hosted parts of the Service — the website, the catalogue, accounts, sync, the engagement counters — and your use of the app and its assets. Using the hosted parts, do not:

You are responsible for what you create and how you use it once you export or share it yourself, outside our hosted services. To report abuse on a hosted surface, email admin@dhureelabs.com with where you saw it and what the problem is; security vulnerabilities should be reported to the same address rather than exploited. We review reports but cannot promise a specific outcome or response time, and we have no obligation to monitor hosted content.

10. Reporting copyright or trademark infringement

We can act only on content hosted on our services — the ready-made catalogue and our own site pages. Because Diagramium is local-first, we hold no copy of users' private diagrams and cannot see or remove them.

To send a complaint, email admin@dhureelabs.com with the subject "Copyright complaint" or "Trademark complaint" and include: the work or mark concerned (with registration details for a registered mark); the exact URL or location of the content on our services; why the use is infringing or confusing; your name, mailing address and email address, and your right or interest in the work or mark; and a good-faith statement that your complaint is accurate. We acknowledge, review, remove or disable well-founded matter from hosted surfaces, keep a record, and where feasible notify the affected user, who may send a reasoned counter-statement to the same address; we may restore content where restoration appears justified, and we may share a counter-statement with the complainant. We are a Canadian service: this is our voluntary complaints procedure under the Copyright Act (Canada), we handle "notice and notice" forwarding where the Act requires it, and we treat notices prepared under other regimes (for example a US DMCA notice) as complaints under this section when they contain the information above. Knowingly false complaints may expose you to liability, and repeat infringers' accounts may be suspended or terminated. Simply naming a product or company in a diagram is generally a descriptive reference we will not remove unless it is likely to confuse people about source, sponsorship or endorsement.

If you send us ideas or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation to you. Please do not send ideas you consider confidential.

14. No warranties

The Service is free and provided "as is" and "as available". To the maximum extent permitted by applicable law, we make no warranties or conditions of any kind — express, implied or statutory — and we do not promise the Service will be error-free, secure, uninterrupted, accurate or fit for any particular purpose. Nothing in these Terms removes rights that applicable law (including applicable Ontario consumer-protection legislation) does not allow to be removed.

15. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any loss or damage arising out of the Service or these Terms — including indirect or consequential loss, loss of data, and loss of diagrams stored only on your own device — and our total liability for everything combined is limited to CAD $50 (the Service is free; there are no payments). Nothing in this section limits liability that applicable law does not allow to be limited, or any non-waivable consumer or privacy right, including under applicable Ontario consumer-protection legislation and PIPEDA.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes belong to the courts of Ontario. These Terms do not require arbitration, do not waive your right to go to court (including Small Claims Court) or to join a class proceeding, and do not take away mandatory consumer protections of the place you live.

18. Changes to these Terms

We may update these Terms. The current version, with its effective date, is always published on this website; we give reasonable advance notice of material changes where practicable; and changes apply from their effective date — keep using the Service and they apply to you, or stop using it (your local diagrams remain yours, on your device). After a material change, signed-in users may be asked to confirm acceptance again, recorded as in Section 4.
